Equitable Mootness, Its Evolving Case Law and Impact on Chapter 11 Practice
>This panel will discuss the evolving case law and parameters of equitable mootness, a doctrine recognized by all circuit courts of appeals. The panelists will examine the doctrine in connection with appellate practice as well as strategic concerns for practitioners at the confirmation stage of bankruptcy proceedings. The panel will also analyze the differences of opinion among the circuit courts of appeal on the scope of the doctrine and its impact on chapter 11 practice.
