Bankruptcy Supreme Court Round-Up: Is Functionalism Back?

The Supreme Court handed down three cases this year in the area. Although seemingly narrow in focus and surprisingly consensual in resolution, that surface veneer masks deeper complexities. As usual, the methodology of textualism comes to the foreground as a recurring issue in the Court's bankruptcy jurisprudence. More regrettably, fundamental misconception (whether willful or inadvertent) with the general structure of the bankruptcy system once again may be rearing its head.
