This program will address issues driving venue selection in chapter 11 cases, with focus on two examples: make whole premiums and third-party releases. The program will provide an overview of venue in chapter 11, discuss status of any pending legislation, and provide a general discussion of the factors often driving venue selection. The panelists will also discuss make whole premiums and releases, with dialogue between speakers on each topic, facilitated by the moderator.

Gender in Judging IV: Communications Between the Bench and Bar and Identifying Potential Implicit Bias Pitfalls (everyone invited)
Are there arguments by counsel that are received differently depending on whether the judges are male or female? When does an argument or statement overstep the line? Can a comment by a judge be perceived differently by male and female attorneys? How can bankruptcy judges and attorneys avoid unintended bias in their arguments or comments? Our diverse panel of judges and attorneys will engage the audience on these issues and discuss how judges and attorneys can recognize and address them. Through sample scenarios, the panel will explore the different reactions that a comment or argument can generate to better understand its impact. Building on the prior programs that have explored the role gender can play in bankruptcy, an experienced professor of legal psychology will provide additional insight based on psychological studies. Finally, we will discuss when such comments can create ethical problems and how to avoid the pitfalls.
